In the year 2011, Parliament of India has passed 97th amendment to our Indian Constitution. Through this amendment, lot of autonomy and freedom to function, is given for cooperative societies along with responsibilities. Moreover, the amendment accepted forming a cooperative as “Fundamental Right”. Meanwhile, some of the sections of the constitutional amendment were challenged in the Hon’. High Court of Gujarat. Against the verdict of High Court of Gujarat, Government of India went into appeal in the Supreme Court of India. Hon. Supreme Court has recently decided the appeal and striking down some of the clauses of the amended Constitution. This has created confusion, uncertainty in the minds of cooperators, researchers, academicians and even officers of Center and State Governments.

ISSC, being academic think tank for cooperatives, is planning to clarify, elaborate on the 97th constitutional amendment and thereafter the verdicts of Hon.’ High Court of Gujarat & Hon.’ Supreme Court of India and future course of actions required by the various stake holds of the cooptative movement. We wish to give more emphasis on the after effects of the verdict of Hon. Supreme Court.
